GENERAL CONDITIONS OF SALE


1. Subject

The following provisions represent a contract establishing the general conditions of the remote sale of products of the sales department of the Rodin Museum.

Placing an order implies that the Customer agrees fully and irrevocably with these general conditions of sale.

3. Information on the products

The site presents the essential characteristics of the products offered:

- name
- dimensions
- number of pages and ISBN no. for the publications
- price including taxes in €..

Photographs illustrating the products are for information only and cannot be considered to be contractual.

4. Contractual documents

The contract is formed by the following contractual documents in decreasing order of priority:

these general conditions;
the Order Form consisting of the accepted estimate, plus the information required to identify the customer (name – forename – postal address for invoicing and delivery address).

5. Order taking

Any Order Form validated by the Customer represents an irrevocable acceptance which can only be questioned in the limited cases mentioned in these general conditions in the "Right of Withdrawal" and "Fulfilment of the order" articles.

The automatic recording systems of the site are considered as equivalent to proof of the contract of sale and its date.

6. Confirmation by e-mail

The following contractual information will be the subject of a confirmation e-mail at the time of delivery at the latest:

- details of the sales department of the Rodin Museum;
- references and essential characteristics of the products;
- method of delivery chosen by the Customer;
- price, including or excluding tax, and delivery costs;
- existence of the right of withdrawal.

7. Right of withdrawal

The Customer has a period of ten working days in which to return products he considers unsatisfactory, at his expense. This period runs from the date of receipt of the products by the Customer.

If this right of withdrawal is exercised, the Customer will have the choice of asking for a refund without costs of the sums paid in return for the return of the products at the Customer’s expense, or the exchange of the product.

The right of withdrawal cannot be exercised for products opened by the Customer.

8. Fulfilment of the order

The order will be fulfilled within a period of 30 days from its confirmation by the Customer at the latest.

If the product ordered is unavailable, the Customer will be informed of this as soon as possible and will have the option to cancel his order. He will then have the choice of asking for a refund of the sums paid within thirty days from their payment at the latest, or the exchange of the product.


9. Delivery

Delivery can only take place once the order has been confirmed by the Customer and payment made.

Furthermore, the Rodin Museum reserves the right to refuse any order from a customer with whom there is a current dispute.

The products are delivered to the address indicated in the Order Form by the Customer, who undertakes to take delivery of the products ordered. If the Customer is absent when delivery is made, a card will be left indicating where the package can be collected or inviting the customer to make a second appointment with the delivery company.

On delivery, the Customer is obliged to check the condition of the packaging and the goods and indicate the damages to the carrier on the delivery note, and to the sales department of the Rodin Museum by e-mail or fax, within three days.

In the case of the non-conformity or damage of the product delivered, the Customer must inform servcom@musee-rodin.fr which undertakes to remedy the situation.

10. Price

The prices are indicated in €, excluding delivery costs invoiced in addition in the Order Form.

These delivery costs are calculated according to the weight and size of the package, its destination and the method of dispatch chosen by the Customer.

Prices indicated in foreign currencies at the request of the Customer are purely for information.

The prices are the prices in force on the date of the order. They include the VAT applicable on the date of the order. Any change in the rate of VAT will be automatically passed on in the prices.

For any delivery outside the territory of the European Union, unless otherwise indicated in the Order Form, customs duties and formalities are the Customer’s exclusive responsibility, and the Customer undertakes to check the possibilities relating to the importation of the products into the country of delivery.




11. Methods pf payment

By cheque: payments can be made by cheque payable to "Agent comptable du musée Rodin" in €


The order will only be accepted and processed on receipt of the cheque accompanied with the Order Form or its reference.

By credit card: the cards accepted are those presented on site. (visa, eurocard, mastercard)

The information relating to the bank card is only retained whilst the order is being processed.

Computerised registers, stored in the computer systems of the Rodin Museum under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.

Orders forms and invoices are filed on a reliable and irreversible medium in such a way as to correspond to a reliable and durable copy, in accordance with article 1348 of the civil code.

12. Personal information

The information the Customer is requested to provide is necessary to process his order and may be divulged to the contractual partners of the Rodin Museum.

In accordance with the French "Computing and Civil liberties" act of 6th January 1978, the Customer can object to these details being divulged and has a right of access, modification, rectification and removal relating to any personal information about him. 13. Indivisibility of the contract

If for any reason whatsoever one of these general conditions should be declared inapplicable, this inapplicability will not affect the application of the other provisions of the general conditions, and the condition considered inapplicable will then be replaced by the closest provision possible.

14. Liability

Neither the Rodin Museum nor the Customer can be held liable for any non-fulfilment caused by a force majeure event, that is outside their control, including in particular and not restricted to war, riot, insurrection, interruption of transport, import or expert problems, strike, lock-out, shortage, fire, earthquake, storm, flood.

In addition, the Rodin Museum cannot be held liable for the use of the products ordered and delivered, since the Customer is solely liable for the use of these products by himself or a third party.

15. Applicable law - settlement of disputes

The contract is subject to French law.

Disputes will come under the jurisdiction of the Paris courts.
